ZONING BOARD OF APPEALS

 REGULAR MEETING

 

April 16, 2009                                                7:30PM                                                Borough Hall

           

ROLL CALL: Chairman Montgomery called the meeting to order at 7:30 PM.  In attendance were members Peg Abramson, Maura O’Malley, Howard Park, Sara Vagliano and alternate member Rowland Stebbins.  Zoning Officer David Atkinson was in attendance.

 

CONTINUATION OF PUBLIC HEARING:

 

Appeal of ZEO Decisions:

 

Application # P05-26, granting of a zoning permit for construction of a detached garage for a single family residence for property located at 39-41 Orchard Street, Stonington, CT; and,

 

Application # P06-09, granting of a zoning permit for construction of a house addition onto a single family residence for property located at 39-41 Orchard Street, Stonington, CT.

 

            Zoning Officer Atkinson read a letter from Attorney Zizka dated April 16 into the record.  Attorney Casey representing the appellant presented reasons why the appeal was brought and is timely.  Attorney Branse, representing the owner of the property Richard Sattler, rebutted.

 

            All parties concur that the issue of standing and the timeliness of the appeal must be determined prior to the merits of the appeal being presented.  Testimony on the timeliness of the appeal, and the issue of whether the applicant has standing concluded at 9:30 PM.

 

            A motion was made by Abramson that the applicant has no standing as the appeal was brought after the appeal period, and therefore the Board has no jurisdiction to hear the appeal.  Motion seconded by O’Malley.  Vote in favor unanimous.  Appeal denied, as the applicant has no standing.  

 

ADJOURNMENT:  Motion to adjourn made by Abramson, seconded by O’Malley. Unanimously approved.  Meeting adjourned at 9:35 PM.
